Terms of Service

By accessing or using MotoFinder ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email or in-app notice.

You agree to:

• Provide accurate and current information when creating an account
• Maintain the security of your account credentials
• Use the Service only for lawful purposes
• Not impersonate any person or entity
• Not use the Service to spam, harass, or harm other users
• Not attempt to gain unauthorized access to any part of the Service
• Not scrape, crawl, or systematically extract data from the Service
• Comply with all applicable local, state, national, and international laws

You are solely responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use at support@mymotofinder.net.

MotoFinder is a community platform for motocross enthusiasts. You agree not to post content that:

• Is abusive, threatening, hateful, or discriminatory
• Harasses or bullies other users
• Contains sexually explicit or graphic violence
• Promotes illegal activity
• Constitutes spam or unsolicited advertising
• Infringes on the intellectual property rights of others
• Contains false or misleading information about tracks or events

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines, without prior notice.

Track owners who list their facilities on MotoFinder represent that they have the legal authority to do so. You agree that all track information you submit — including hours, pricing, amenities, and contact details — is accurate and will be kept current.

Track owners are responsible for ensuring their facilities comply with all applicable safety regulations, insurance requirements, and local ordinances. MotoFinder is a discovery and community platform and is not responsible for conditions at listed tracks.

MotoFinder offers the following paid plans:

• Track Owner Plan: $19.99/month — includes track management, event management, and free promotion of your own tracks and events.
• Rider Plus: $3.99/month — includes premium rider features, messaging, and community access.
• Standard Event Promotion: $10.00 one-time fee per promoted event (non-track-owners).
• Featured Event Promotion: $25.00 one-time fee for premium placement (non-track-owners).

Subscriptions are billed monthly and will automatically renew unless cancelled before the renewal date. All payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Prices are listed in USD. We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

Subscriptions: We do not offer refunds for subscription payments already charged. If you cancel your subscription, you will retain access until the end of the current billing period.

One-time Promotions: Promotion fees are non-refundable once a campaign has been activated. If a promotion has not yet been activated (pending admin review), please contact us within 24 hours of purchase to request a refund.

Event Registration: Refunds for event registration fees are determined by the event organizer, not MotoFinder. Contact the event organizer directly for their refund policy.

MotoFinder provides a platform for discovering and registering for motocross events. We are not the organizer of any events listed on the platform unless explicitly stated.

Participation in motocross events is inherently dangerous. You acknowledge that riding motorcycles and participating in racing events carries significant risk of injury or death. By using MotoFinder to register for or attend events, you assume full responsibility for your participation and any associated risks.

MotoFinder is not responsible for event cancellations, changes, or the conduct of event organizers. Always verify event details directly with the organizer before attending.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOTOFINDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of third parties on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Participation in any event, track visit, or ride organized through the platform

IN NO EVENT SHALL MOTOFINDER'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO MOTOFINDER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You may delete your account at any time by contacting us at support@mymotofinder.net. Upon deletion, your personal data will be removed within 30 days, subject to our data retention policy.

We reserve the right to suspend or terminate your account, with or without notice, if you:

• Violate these Terms or our Community Guidelines
• Engage in fraudulent or illegal activity
• Provide false information
• Fail to pay subscription fees when due

Upon termination, your right to use the Service ceases immediately. Subscription fees already paid are non-refundable upon termination for cause.

The MotoFinder name, logo, branding, and all platform software, design, and original content are owned by MotoFinder and protected by applicable intellectual property laws.

You retain ownership of content you submit. By posting content on MotoFinder, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the Service and for promotional purposes related to MotoFinder.

You represent that you have the right to submit any content you post and that it does not infringe on the intellectual property rights of any third party.

The Service integrates with third-party services including Stripe (payments), Mapbox/OpenStreetMap (maps), and others. Your use of these services is subject to their respective terms and privacy policies. MotoFinder is not responsible for the practices of third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration or in courts of competent jurisdiction.
